These Terms of Use ("Terms") govern your use of the WightExplorer website, mobile application and related services (together, "WightExplorer" or the "Service").
WightExplorer is operated by Wight Explorer Ltd ("WightExplorer", "we", "us" or "our").
By accessing or using WightExplorer, you agree to these Terms. If you do not agree to these Terms, you should not use the Service.
WightExplorer is a local discovery service designed to help users discover events, places to visit, groups, classes, parks, walks and other activities on the Isle of Wight.
WightExplorer provides information to help users discover things to do. We are not generally the organiser, venue, ticket seller or provider of the events, activities or services listed on the Service.
An event, venue, business or other organisation appearing on WightExplorer does not necessarily mean that WightExplorer recommends, endorses or guarantees that organisation or its services.
We aim to provide useful, accurate and up-to-date information. However, event and listing information may come from event organisers, venues, businesses, public sources and other third parties, as well as information researched or compiled by WightExplorer.
We do not guarantee that information displayed on WightExplorer is complete, accurate, reliable or current.
Event details may change after a listing has been published. This may include, but is not limited to:

You should always check the event organiser's or venue's website, booking page or other official source before travelling to an event or making plans based on information displayed on WightExplorer.
WightExplorer is intended for people aged 18 and over.
You must be at least 18 years old to create an account or use WightExplorer.
By creating an account or using WightExplorer, you confirm that you are at least 18 years old.
We do not knowingly permit anyone under the age of 18 to create an account or use the Service. If you are under 18, you must not create an account or use WightExplorer.
If we become aware that an account has been created by, or is being used by, someone under the age of 18, we may suspend or terminate the account and take appropriate steps in accordance with our Privacy Policy and applicable data protection law.

WightExplorer may provide links to websites where users can obtain tickets, make bookings or purchase goods or services relating to an event.

WightExplorer is not responsible for the availability, price, validity or delivery of tickets or bookings, or for any refund, cancellation or dispute relating to a transaction with a third party.
You should review the relevant third party's terms and conditions before making a purchase or booking.
WightExplorer may contain links to websites, booking platforms, social media pages, maps and other services operated by third parties.
These links are provided for convenience and do not constitute an endorsement or recommendation by WightExplorer.
We do not control third-party websites or services and are not responsible for their content, availability, security, privacy practices, terms, products, services or transactions.
Your use of a third-party website or service is subject to that third party's own terms and policies.

If you submit information, images, photographs, logos, artwork or other material ("Submitted Content"), you confirm that:
By submitting content to WightExplorer, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, format, publish and display that content for the purposes of operating, promoting and improving WightExplorer.
This licence allows us to display Submitted Content within the WightExplorer app, website, social media, marketing materials and other WightExplorer promotional channels.
You retain ownership of any intellectual property rights you hold in your Submitted Content.
We may edit, resize, crop, format or otherwise modify Submitted Content where reasonably necessary for publication or presentation within the Service.
We may also refuse, edit, restrict or remove Submitted Content at our discretion, including where we believe it may breach these Terms or applicable law.
Event listings may contain photographs, promotional artwork, logos and other images supplied by organisers or other third parties, or otherwise used in connection with promoting an event or place.
Where an image credit is required or has been provided, WightExplorer will make reasonable efforts to display the appropriate credit.
The copyright or other intellectual property rights in third-party images and materials remain with their respective owners unless otherwise stated.
WightExplorer does not claim ownership of third-party photographs, logos, artwork or other materials merely because they appear on the Service.
If you believe that an image, photograph, logo or other material displayed on WightExplorer infringes your intellectual property rights, please contact us at app@wightexplorer.com with sufficient information for us to identify the material and understand your concern.
We may remove or temporarily disable access to material while we investigate a complaint.
The WightExplorer name, logo, branding, software, website, app interface, design, original text, graphics and other materials created by or for WightExplorer are owned by or licensed to Wight Explorer Ltd and are protected by applicable intellectual property laws.
Except where permitted by law, you must not copy, reproduce, modify, distribute, sell, publish, commercially exploit or create derivative works from WightExplorer's proprietary materials without our prior written permission.
Third-party content displayed through WightExplorer remains the property of its respective owners.
You agree to use WightExplorer lawfully and responsibly.

A promoted listing may receive additional visibility or placement within the Service and will be identified as a promoted, sponsored or otherwise paid listing where appropriate.
Payment for promotion does not constitute an endorsement or guarantee by WightExplorer of the event, organisation, business or service.
We do not guarantee that a promoted listing will generate a particular number of views, bookings, ticket sales or other results.
We reserve the right to reject or remove promotional content that does not meet our requirements or these Terms.
If you are an event organiser, business, venue or other organisation using WightExplorer to promote an event or listing, you are responsible for ensuring that the information you provide is accurate and complies with applicable laws.
You are responsible for notifying WightExplorer of material changes to your listing where reasonably necessary, including significant changes to event dates, times, locations, prices or cancellation status.
WightExplorer may contact you regarding your listing or request information to verify or update it.
We may amend, suspend or remove a listing where information appears to be inaccurate, outdated, misleading or otherwise unsuitable for the Service.
Being listed on WightExplorer does not create an agency, partnership, joint venture or other relationship between WightExplorer and the organiser, venue or business unless separately agreed in writing.
We aim to keep WightExplorer available and functioning properly, but we do not guarantee that the Service will always be available, uninterrupted, secure or error-free.
The Service may occasionally be unavailable because of maintenance, updates, technical problems, third-party services, network issues or circumstances beyond our reasonable control.
We may modify, suspend or discontinue any part of WightExplorer at any time.
We may also introduce new features or remove existing features as the Service develops.
WightExplorer is provided as an information and discovery service.
To the fullest extent permitted by law, we do not guarantee that:
You are responsible for deciding whether an event, venue, activity or service is suitable for you and for checking important information with the relevant organiser or provider.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory rights or remedies that cannot legally be excluded or restricted.
Subject to the above, to the fullest extent permitted by law, Wight Explorer Ltd will not be responsible for indirect or consequential losses arising from your use of, or inability to use, WightExplorer.
We are not responsible for losses, costs or damages arising from events, venues, businesses, ticket providers or other third parties listed or linked to through WightExplorer.
In particular, WightExplorer is not responsible for losses arising from event cancellations, postponements, changes, ticket purchases, bookings, travel arrangements, accommodation, food, services or other arrangements made with an event organiser or third party.
Nothing in these Terms affects your statutory rights as a consumer.
If you use WightExplorer on behalf of an organisation, including as an event organiser or business, you agree to be responsible for losses, claims, liabilities and reasonable costs arising from your Submitted Content or your breach of these Terms, to the extent permitted by law.
This section does not apply to the extent that the relevant loss or claim was caused by WightExplorer's own breach of these Terms or applicable law.
We may suspend or terminate your access to WightExplorer, including your account, where we reasonably believe that you have:

If you have an account, you may request that your account be deleted in accordance with our Privacy Policy.
Termination of access does not affect provisions of these Terms that are intended to continue after termination, including provisions relating to intellectual property, liability and applicable law.

The updated Terms will be made available through WightExplorer and will show the date on which they were last updated.
Your continued use of WightExplorer after updated Terms take effect constitutes acceptance of those updated Terms.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
Our failure to enforce a provision of these Terms does not mean that we waive our right to enforce it later.

These Terms do not create an employment, partnership, agency or joint venture relationship between you and Wight Explorer Ltd.
These Terms are governed by the laws of England and Wales.
If you are a consumer, you will also benefit from any mandatory protections provided by the laws applicable to you and nothing in these Terms prevents you from exercising rights that cannot legally be excluded.
Subject to those consumer rights, the courts of England and Wales will have jurisdiction over disputes arising from these Terms.
